When Is an Autopsy Mandatory in Florida?
What Families Should Know After a Loved One Passes Away
Learning that a loved one has been taken to the Medical Examiner’s Office can feel overwhelming and frightening. Families often have immediate questions:
“Is an autopsy required?”
“Can we still choose cremation?”
“What happens next?”
At Going Home Cremations, we help Florida families understand the process with compassion, professionalism, and dignity.
Is an Autopsy Always Required?
No. An autopsy is not always required. However, in Florida, certain types of deaths must be reviewed by the Medical Examiner’s Office. These may include sudden or unexpected deaths, accidents, injuries, unattended deaths, possible overdoses, deaths without a physician present, or deaths involving suspicious circumstances.
The Medical Examiner determines whether an autopsy or other examination is necessary to confirm the cause and manner of death.

Can Families Refuse an Autopsy?
Families may express personal, cultural, or religious concerns about an autopsy. In some cases, the Medical Examiner may consider alternatives, such as an external examination, limited examination, imaging, scans, or toxicology testing.
However, if the death falls under Medical Examiner jurisdiction, the final decision is made by the Medical Examiner.
For more information, families can review Florida Statute 406.11 here:

Can Cremation Still Take Place After the Medical Examiner?
Yes. Cremation can still take place after the Medical Examiner has completed their process and released your loved one.
Going Home Cremations can help coordinate the next steps, including transportation into our care, cremation arrangements, death certificate guidance, urn and keepsake selections, celebration of life planning, and veteran memorial assistance.
